The petitioners apprehend their arrest in connection with Warisaliganj P.S. Case No. 212 of 2018 for the offence punishable under Sections 143, 144, 337, 332, 333, 353 and 379 of the Indian Penal Code and Section 4/40 of the Bihar Minor & Mineral Concession Rule, 1972 and 21 of Mines & Mineral (Development and Regulation) Act, 1957, Rule 3/8 of Bihar Mineral (Prevention of illegal Mining, Transportation & Storage) 2003 and Section 15 of
Patna High Court CR. MISC. No.62508 of 2019(2) dt.18-10-2019 2/2 Environmental Protection Act, 1986.
Learned counsel appearing for the petitioners submits that the petitioners, who are of clean antecedent, are innocent and have not committed any offence. In fact, the co-accused having more or less similar allegation has already been granted anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No. 71753 of 2018 and the case of these petitioners stands on similar footing. Hence, the petitioners may be granted the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the, above named, petitioner in the event of surrender within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M.-I, Nawada in connection with Warisaliganj P.S. Case No. 212 of 2018 subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Arvind Srivastava, J) brajesh/- U T
