====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 06-11-2023 Heard Mr. Ashok Kumar Garg, learned counsel appearing on behalf of the petitioner and Mr. Braj Bhushan Mishra, learned AC to AAG-9 for the State.

2. The petitioner has filed the present writ petition for the following reliefs:

(i) For issuance of an appropriate writ, order or direction in the nature of mandamus directing the respondent authorities to pay entire retiral benefits with all consequential benefits within stipulated period to the petitioner.

(ii) For grant of any reliefs, the petitioner would be found entitled to in the facts and circumstances of the case including the cost of the petition to the petitioner.

3. Learned counsel appearing on behalf of the

Patna High Court CWJC No.15304 of 2023 dt.06-11-2023 2/2 petitioner submits that the petitioner has given instruction that he will file a detailed representation before the respondent no.3 - Director-in-Chief, Health Services, Bihar for redressal of the grievance as prayed for in the present writ petition, which relates to payment of retiral benefits of the petitioner who had retired on 13.02.2023 from the post of clerk.

Considering the aforesaid submission made on behalf of the petitioner, the Director-in-Chief, Health Services, Bihar - respondent no.3 is directed to take final decision ensuring redressal of the grievance of the petitioner as prayed for in Para-1 of the present writ petition within a period of six weeks from the date of communication of this order. Respondent no.3 must also ensure to make payment of interest on account of delay in making payment from the date of entitlement of the petitioner till the date of payment.

5. The writ petition stands disposed of.
