Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 19.6.2017 passed in Cr. Misc. No.20012 of 2017 with observation to renew his prayer for bail after seven months, if the trial is not concluded. Submission of the learned counsel for the petitioner is that seven months' period has already expired and the charge has not been framed in this case. The petitioner is in custody since 30.3.2017 and recovery is of 1.7 kg. Ganja.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty

Patna High Court Cr.Misc. No.14920 of 2018 (2) dt.14-03-2018 2/2 Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, N.D.P.S. Act-cumAdditional Sessions Judge Ist, Munger in connection with Naya Ram Nagar (Safia Sarai O.P.) P.S.Case No.163 of 2016 with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.

With the aforesaid observation, this application is allowed.
