The petitioner is accused in connection with Danapur P.S. Case No. 345 of 2016, registered under Sections 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the prayer for bail of the petitioner was refused on 28.04.2017 vide Criminal Miscellaneous No. 14963 of 2017 taking into consideration that the petitioner and two others were identified by the informant at the time of occurrence causing fire arm injury to Ashok Jaishwal, father-in-law of the informant, but after commitment the case has been numbered as Sessions

Patna High Court Cr.Misc. No.15930 of 2018(2) dt.18-04-2018 2/2 Trial No. 530 of 2017 and the informant Richa Jaishwal has been examined as P.W.2, but she did not claim to identify anyone as assailant. Further submission is that Dinesh Singh, who is said to be identified by the informant has already been allowed privilege of bail by a Bench of this Court vide Criminal Miscellaneous No. 18461 of 2018 on 04.04.2018. The petitioner is in custody since 23.08.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Danapur in connection with Danapur P.S. Case No. 345 of 2016. (Rajendra Kumar Mishra, J) manish/- U T
