Petitioners, already in custody, seek bail in connection with Wajirganj P.S. Case No.565 of 2017, corresponding to G.R. No.3388 of 2017, registered under Sections 363/366(A)/34 of the Indian Penal Code.

Allegation in brief is that the petitioners along with others kidnapped 13 years old minor daughter of the informant and forcibly got her married with one Ankit Kumar, son of petitioner no.2.

Submission is that the girl was recovered from Viwadi, Rajasthan, both were in love relationship and the petitioner no.1 is the cousin of Ankit Kumar and petitioner no.2 is the father of

No.17355 of 2018(2) dt.27-03-2018 2/2 Ankit Kumar whereas the learned counsel for the State submits that the girl is admittedly minor and she has stated in her statement recorded under Section 164 Cr.P.C. that Ankit Kumar, Vikash Kumar, Niwash Kumar, Gaurav Kumar and Gopal Kumar forcibly kidnapped her and the allegation against petitioner no.2 is that being father of Ankit Kumar, he assured the girl to keep her nicely and they all again forcibly taken her to Delhi.

Having considered the aforesaid facts and circumstances, specially the nature of offence, the petitioners' prayer of bail is rejected in connection with Wajirganj P.S. Case No.565 of 2017, pending in the court of learned ACJM-1, Gaya. (Arun Kumar, J) S.KUMAR/- U T
