1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Rupaspur P.S. Case no.421 of 2021 registered under section 392 of the Indian Penal Code.
3. As per the prosecution case, two unknown accused persons on a motorcycle overtook the informant who was on a scooty. It is stated that on the point of pistol and a gun, the informant was dispossessed of the articles as mentioned in the F.I.R as also his motorcycle.
4. Learned counsel for the petitioner submits that the F.I.R was registered against two unknown accused persons on the motorcycle bearing Registration no. BR01DR-2398, with which the petitioner has no connection. Referring to the order of
Patna High Court CR. MISC. No.68753 of 2023(2) dt.01-11-2023 2/2 the learned Court below, learned counsel for the petitioner submits that the petitioner was remanded in the case by the prosecution mainly relying on the confessional statement of the petitioner made before police and his criminal antecedents. The petitioner is in custody since 17.9.2021 and charge-sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the submissions made, the material that has transpired in course of investigation as is evident from the order of the learned trial Court rejecting the application for bail of the petitioner, the petitioner being in custody for more than 2 years since 17.9.2021 and investigation in the case having concluded, the petitioner is directed to be enlarged on bail in connection with Rupaspur P.S. Case no.421 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Danapur, Patna.
