2.The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 20(b)(ii)B, 29, 27(a) of N.D.P.S Act.
3. The case of the prosecution is that the police got secret information that petitioner has kept ganja at his house and upon search, recovered 3.250 kg ganja from a plastic bag, kept in the house of the petitioner.
4.Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that the contraband which has been recovered from the petitioner is little more than small quantity and less than commercial quantity. The petitioner has got three criminal
Patna High Court CR. MISC. No.73484 of 2024(4) dt.28-01-2025 2/2 antecedent out of which one is of similar nature. The petitioner is languishing in judicial custody since 17.08.2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6.Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Buxar P.S. Case No. 447 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judgecum-Special Judge, N.D.P.S.
