2. The petitioner apprehends their arrest in a case registered for the offence under Sections 406, 408, 409 of the Indian Penal Code.

3 . As per F.I.R. this petitioner in connivance with other co-accused persons of Gram Panchayat "Chhitahi Hanuman Nagar" misappropriated government money without completion of the work under the "Mukhyamantri Gali Pakki karan Nischay Yojana".

4. Learned counsel for the petitioner submits that at the relevant time , petitioner was Mukhiya . It is further submitted that co-accused Pran Safi who was Panchyat secretary has already deposited the entire alleged amount of Rs.

Patna High Court CR. MISC. No.68012 of 2025(2) dt.08-12-2025 2/2 11,57,600/- in the account of concerned Gram Panchayat on 12.03.2024, 28.02.2024, 08.05.2025 and 09.05.2025 . Petitioner is lady and claims clean antecedent. Similarly situated coaccused persons have already been granted bail by this Hon'ble Court vide order dated 09.09.2025 in Cr. Misc. No. 58866 of 2025 .

5 . Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the fact that the alleged misappropriated amount has already been deposited by the petitioners and petitioners have clean antecedent, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate , Supaul in connection with Bhaptiyahi P.S. Case No. 120 of 2023 , subject to condition as laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the B.N.S.S.
