JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 10-01-2025 Learned counsel for the petitioners seeks permission to withdraw the anticipatory bail petition of Petitioner Nos. 2 and 3 with liberty to surrender before the Court below.
2. Permission is accorded.
3. Accordingly, the anticipatory bail petition with respect to Petitioner Nos. 2 and 3 is dismissed as withdrawn.
4. Heard learned counsel for Petitioner Nos. 1 and 4 and learned A.P.P. for the State.
5. Petitioner Nos. 1 and 4 apprehend their arrest in connection with Buxar (Muffasil) P.S. Case No. 515 of 2023,
Patna High Court CR. MISC. No.73148 of 2024(3) dt.10-01-2025 2/3 instituted under Sections 341, 323, 324, 325, 307, 504, 506, 147, 149 of the Indian Penal Code.
6. As per the prosecution case, on the date of occurrence F.I.R. named accused persons including petitioners armed with weapon came and assaulted the informant causing injury. Petitioner No. 1 is alleged to have assaulted the informant by means of sword on his neck and Petitioner No. 4 is alleged to have assaulted the informant with other co-accused persons.
7. Learned counsel for Petitioner Nos. 1 and 4 submits that they are innocent and have falsely been implicated in this case. Petitioners and informant are next door neighbours. Allegation against Petitioner no. 1 is not corroborated by the medical report of injured. There is no injury upon the neck of the informant. There is general and omnibus allegation of assault. Petitioner No. 1 has no criminal antecedent and Petitioner No. 4 has one criminal antecedent in which he is on bail. They undertake to co-operate in the investigation. It is further submitted that similarly situated co-accused persons have already been granted anticipatory bail by this Court vide order dated 18.03.2024 passed in Cr. Misc. No. 15433 of 2024.
8. Learned A.P.P. for the State opposes the prayer for
Patna High Court CR. MISC. No.73148 of 2024(3) dt.10-01-2025 3/3 anticipatory bail.
9. Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, Petitioner Nos. 1 and 4 be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar in connection with Buxar (Muffassil) P.S. Case No. 515 of 2023, subject to the conditions laid down in Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
