2. This is the 2nd attempt of the petitioner in connection with Kudra P.S. Case No. 201 of 2025 registered for the offence under Sections 8(c), 20(b) and 29 of the NDPS Act.

3. Earlier the bail application of the petitioner was rejected on 25.06.2025 in Cr. Misc. No. 38875 of 2025 which reads as follows:- Heard the learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks regular bail in connection with Kudra P.S. Case No. 201 of 2025 registered for the offence under Sections 8(c), 20(b) and 29 of the N.D.P.S. Act.

3. As per the prosecution case, there is recovery of 3.068 Kg of ganja from the petitioner.

4. Learned counsel for the petitioner

Patna High Court CR. MISC. No.66571 of 2025(2) dt.31-10-2025 2/2 submits that the petitioner is innocent and has not committed any offence. The petitioner is in custody since 09.05.2025.

5. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances and the fact that there is huge quantity of recovery, I am notinclined to grant bail to the petitioner.

7. Accordingly, this application for regular bail is hereby rejected.

4. In the opinion of this Court, this case has been filed prematurely, therefore, this application is dismissed with liberty to the petitioner to file a fresh bail application in the year 2026. (Sandeep Kumar, J) Shishir/- U T
