JUSTICE BIRENDRA KUMAR ORAL ORDER 20-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offence punishable under Section 27 of the N.D.P.S. Act. Submission is that only 28 gms of Ganja has been allegedly recovered from the possession of the petitioner. Petitioner is in custody since 07.12.2017. Investigation of the case is already complete now and the petitioner is ready to cooperate in the trial.

Considering the fact that small quantity of narcotic was recovered from the possession of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the

Patna High Court Cr.Misc. No.15438 of 2018 (2) dt.20-03-2018 P2/ like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Chowk P.S. Case No.399 of 2017 (Special Case No.185 of 2017), with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
