The petitioner seeks regular bail in connection with Sono Police Station Case No. 338 of 2020 (Sessions Trial No. 150 of 2021), registered for the offences punishable under Sections 302/120-B/34 of the Indian Penal Code. This is the second attempt on behalf of the petitioner for grant of regular bail. Earlier, the prayer for regular bail of the petitioner was permitted to be withdrawn by this Court, vide order, dated 18.05.2022, passed in Criminal Misc. No. 40408 of 2021, giving liberty to the petitioner to renew his prayer for bail after five months.

The allegation, as per the First Information Report, is that co-accused Toofani Yadav beheaded the son of the

Patna High Court CR. MISC. No.67941 of 2022(2) dt.07-12-2022 2/3 informant by means of sword.

Learned Counsel for the petitioner submits that the petitioner has renewed his prayer for bail, as observed by this Court. He further submits that the petitioner is not named in the First Information Report and he has been implicated in this case on the basis of confessional statement of co-accused Toofani Yadav. He further submits that in course of investigation, no incriminating material has come against the petitioner and the petitioner is in custody since 26.12.2020. He next submits that charges have been framed against the petitioner in this case. After having heard learned Counsel for the parties and taking into consideration the fact that the petitioner has been made accused in this case on the basis of the confessional statement of co-accused, charges have been framed against him, he is in custody since 26.12.2020 and this is second attempt on behalf of the petitioner for grant of bail, I am inclined to grant regular bail to the petitioner.

This application is, accordingly, allowed.

Let the petitioner, above named, be released on bail, upon furnishing bail bonds of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Jamui, in connection with

Patna High Court CR. MISC. No.67941 of 2022(2) dt.07-12-2022 3/3 Sono Police Station Case No. 338 of 2020 (Sessions Trial No. 150 of 2021).

This is subject to the condition that the petitioner shall present himself before the Court, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
