JUSTICE ARUN KUMAR ORAL ORDER 21-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Rail Thana Kiul PS Case No. 229 of 2017 registered under Sections 328, 379 and 411 of the IPC.

The allegation in brief is that while the informant was traveling in a train, a stranger offered him some biscuits and on eating it he became unconscious and all his belongings were taken away.

Submission is that there is no recovery of any stolen article from the possession of the petitioner except so called railway ticket, some tablets and biscuits, moreover he was also not put on TIP and the petitioner has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Ghanshyam Kumar @ Sonu is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Rail Kiul, Lakhisarai in connection with Rail Thana Kiul PS Case No. 229 of 2017.
