Petitioner is languishing in judicial custody since 18.12.2017 in connection with Paharpur P.S. Case No. 33 of 2009 for offences punishable under Sections 147, 148, 149, 323, 324, 337, 341, 325, 307, 353, 436, 427, 379 of the Indian Penal Code, Section 27 of the Arms Act and 3/5 of Damage of Public Property Act.
The prosecution case, as lodged by the police
Patna High Court Cr.Misc. No.15092 of 2018 (2) dt.15-03-2018 2/3 personnel, is that a truck had dashed a boy and killed him on the road for which 300 people assembled and blocked the road. When the police party reached there, they were pelted bricks, stones and injured the police party and also damaged the police vehicles. Accordingly, as many as 30 persons have been named in the F.I.R. including the petitioner. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and earlier his pre-arrest bail was granted by the learned court below but he could not furnish bail bonds and thereafter he was taken to custody. He submits that many accused persons named in the F.I.R. have been granted the privilege of bail by this Court and that the allegations are general and omnibus.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East
