2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323 and 307 of the IPC and Section 27 of the Arms Act.

3. As per FIR, it is alleged that the petitioner fired from pistol, which hit the leg of the brother of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that in the background of previous dispute with regard to the land, the petitioner has been roped in the present case.

5. Learned APP for the State opposed the prayer for bail and submits that the injury caused by this petitioner is

6. Considering the nature of injury caused by this petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Sandesh P.S. Case No. 10 of 2023.

7. However, if the petitioner surrenders before the learned court below within a period of six weeks from today and prays for regular bail, the same shall be considered by the learned court below on the same day without being prejudiced by this order.
