Petitioners, already in custody, seek bail in connection with Madhepur P.S. Case No.57 of 2017, registered under Section 392 of the Indian Penal Code.

Submission is that the FIR is against unknown, allegation is of robbing Rs.40,000/- from the informant and it is alleged that Rs.11,500/- was recovered from possession of the petitioners, which is their personal money moreover both petitioners were not put on TIP and prior to lodging of the present case both petitioners had no criminal antecedent but after institution of the preset case made accused in three other cases however similarly situated other co-accused have been admitted to bail by a coordinate

Patna High Court Cr.Misc. No.15239 of 2018(2) dt.21-03-2018 2/2 Bench of this Court by order dated 17.01.2018, passed in Cr. Misc. No.3246 of 2018 and the petitioners are in custody since 30.08.2017.

Having considered the aforesaid facts and circumstances, petitioners, namely, Kishan Kumar and Anand Kumar @ Anand Yadav are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Jhanjharpur, Madhubani in connection with Madhepur P.S. Case No.57 of 2017.
