Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.

The petitioner seeks regular bail in connection with Jamui P.S. Case No. 397 of 2022 lodged under Section 392 of the I.P.C.

As per the prosecution case, the allegation of robbery is there in the F.I.R. against four unknown accused persons. Learned counsel for the petitioner submits that there is one criminal case pending against the petitioner in which he is on bail. Counsel further submits that petitioner is in custody since 12.09.2022 in which charge sheet has already been filed. Learned counsel for the State opposes the prayer for

Patna High Court CR. MISC. No. 71015 of 2022(2) dt.25-03-2023 2/2 bail and submits that from the rejection order of the Additional Sessions Judge-IV, Jamui, it transpires that recovery of the laptop and looted articles have been made from the possession of the petitioner.

In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner, therefore, his bail petition is hereby rejected. But liberty is hereby granted that he may renew his prayer for bail two months after framing of charge and the Trial Court is directed to release him on bail, thereafter, imposing its own conditions, so that he may not evade his appearance during trial.

With this observation, the bail application stands rejected.
