Petitioner seeks bail in a case registered for the offences punishable under Sections 392/34 of the Indian Penal Code.
The FIR of the occurrence of robbery is against unknown. The petitioner was remanded from some other case on 10.10.2017. Thereafter, the petitioner was never put on TI Parade nor anything was recovered from the possession of the petitioner. Investigation is complete now. Only material is confessional statement of the petitioner before police and his criminal antecedent.
Submission is that a tendency has developed in the police system to implicate any innocent person only on the
Patna High Court Cr.Misc. No.7854 of 2018 (2) dt.09-02-2018 2/2 basis of criminal records and without verifying other details regarding involvement of the arrested person. They are simply sent up for trial without collection of any evidence. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Halsi Police Station Case No. 43 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
Let a copy of this order be sent to the Superintendent of Police, Jamui for needful.
