JUSTICE PURNENDU SINGH ORAL ORDER 17-05-2023 The petitioner seeks pre-arrest bail in connection with Tekari (Mou O.P.) P.S.Case No.25 of 2022 dated 12.1.2022, registered for the offences punishable under Sections 498(A) and 506/34 of the Indian Penal Code and Sections 3 & 4 of Dowry Prohibition Act.

Prosecution story, in brief, is that marriage of the informant was solemnized with the petitioner on 23.11.2017 according to the Hindu rites and rituals. Thereafter, the petitioner took her at his service place and kept there in good manner but after some time he started demanding Rs.5,00,000/- as dowry and due to non-fulfilment of the same, he started torturing her. In this regard, panchayati was also held but the

Patna High Court CR. MISC. No.67081 of 2022(3) dt.17-05-2023 2/2 demand of dowry continued and the mother-in-law of the informant threatened to get another marriage of his son and the members of the in-laws of the informant also abused her father and tried to assault him.

Learned counsel appearing on behalf of the petitioner informs this Court that the petitioner has already filed matrimonial case for divorce against the O.P.no.2. In such circumstances, the petitioner is directed to surrender before the court below and file application for regular bail bringing on record all the materials in his defence and the the learned court below is directed to consider the regular bail application filed on behalf of the petitioner on the same day and pass necessary order without being prejudiced by any order.

The petitioner is granted three weeks time from today to file regular bail application till date no coercive action shall be taken against the petitioner in connection with Tekari (Mou O.P.) P.S.Case No.25/2022.

If the regular bail application is not filed within the aforesaid period, the interim protection granted to the petitioner shall loose its force.
