The petitioners seek bail in a case registered for offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 14.040 litres of Nepali saufi wine was recovered from the joint possession of the petitioners. Petitioners claim that they are having clean antecedent and are in custody since 01.03.2018. Having regard to the facts and the circumstances of the case, the abovenamed petitioners are directed to be released on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.20034 of 2018(2) dt.19-04-2018 2/2 satisfaction of the A.D.J. II-cum-Special Judge, Excise Act, Sitamarhi in connection with G.O. Case No. 47/18. Further, if the petitioners, after their release in this case, are again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of their bail bonds.
However, before accepting the bail bond, the court below would make verification regarding criminal antecedent of the petitioners and if they are found to be involved in any criminal case prior to this application, i.e. 26.03.2018, then they would not be released.
