Heard learned counsel for the petitioner and learned A.P.P for the State.
The petitioner has preferred this application for grant of regular bail in connection with Khajauli P. S. Case No. 113 of 2022 registered for the offence punishable under sections 413, 414, read with Section 34 of the Indian Penal Code and Section 25 (1-B)a, 26, 35 of the Arms Act.
As per the prosecution case, three miscreants boarded on Apache motorcycle tried to flee away but they were apprehended by the police. On being asked, the miscreants
Patna High Court CR. MISC. No.67118 of 2022(2) dt.23-03-2023 2/3 disclosed their names as Chandan Kumar Sah, Raja Babu Sharma and the petitioner (Chatura @ Chaturanand). On search, one country-made pistols, three live cartridges, 12 notes of Rs. 500/- and a blank cheque of the name of Awadhesh Kumar Yaday were recovered from the possession of the petitioner. One loaded magazine, two live cartridges, two notes of Rs. 2000/-, two notes of Rs. 500/- and one mobile phone were also recovered from the co-accused Raja Babu Shah. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. No such occurrence as alleged has ever taken place. Nothing has been recovered from the conscious possession of the petitioner. The name of the petitioner has been dragged in this case on mere suspicion. Learned counsel has further submitted that the charge-sheet has been submitted in this case. The petitioner is accused in five other criminal cases as stated in para 3 of the bail petition. The petitioner is in custody since 27.06.2022.
Learned A.P.P. for the State has vehemently opposed the prayer of bail of the petitioner.
Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-
Patna High Court CR. MISC. No.67118 of 2022(2) dt.23-03-2023 3/3 named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Madhubani in connection with Khajauli P. S. Case No. 113 of 2022 with the condition:-
1. the petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner is liable to be cancelled. The application stands allowed.
