Although the writ petition was filed seeking a direction to the respondents for payment of the maturity value of the group insurance admissible to the petitioner in respect of his deceased father but when the matter is taken up for consideration, it is submitted by Mr. Randhir Kumar Singh appearing for the petitioner that he would not be pressing the relief insofar as it is directed towards the Life Insurance Corporation but would be

Patna High Court CWJC No.13134 of 2013 (6) dt.30-03-2016 praying for a direction to the Bihar State Housing Cooperative Federation to enter into a One Time Settlement with the petitioner in respect of the loan advanced in favour of his deceased father. Since Mr. Singh, learned counsel for the petitioner has chosen not to press the relief insofar as it would involve the Life Insurance Corporation rather the prayer made by Mr. Singh is for a direction to the Federation to enter into a One Time Settlement, in my opinion the Federation being a registered Cooperative Society, a writ would not lie for the purpose and the remedy for the petitioner for the relief so prayed would be either before the Federation itself or under the provision of Section 48 of the Bihar Cooperative Societies Act, 1935 and if so advised the petitioner would be at liberty to exhaust the same.
