JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 13-10-2020 Heard learned counsel for the petitioners and learned APP for the State through virtual court proceedings. The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 341, 323, 324, 307, 504 of the Indian Penal Code.

Allegation against the petitioners is of assaulting the informant and his son by means of iron rod, sword, fatha etc. Learned counsel for the petitioners submits that the petitioners are quite innocent and have falsely been implicated in the present case. Injury report of the informant enclosed as Annexure-2 showing the nature is simple and causing hard blunt substance. The petitioners have got no criminal antecedent

Patna High Court CR. MISC. No.75179 of 2019(4) dt.13-10-2020 2/2 which is mentioned in para 3 of the bail petition. Learned APP for the State opposes the prayer for bail petition.

In the aforesaid facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Bela P. S. Case No. 102 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
