2. Petitioner seeks regular bail in connection with Bhagwanpur P. S. Case No. 143 of 2025 in a case registered for the offences punishable under Sections 103(1), 238(a), 3(5) of the Bharatiya Nyaya Sanhita.
3. Prosecution case, in brief, is that on 08.05.2025 informant, who is posted as local Chowkidar in Bhagwanpur police station, received information that dead body of a person is lying on the roadside in Tajpur village. When informant reached there he found that dead body of an unknown person was lying in a sack. Accordingly, the F.I.R.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name transpired
Patna High Court CR. MISC. No.66280 of 2025(3) dt.11-11-2025 2/2 during course of investigation on the basis of confessional statement of co-accused Manjay Kumar. Save and except suspicion, there is no other material available on record to show complicity of the petitioner in the alleged offence. None of the witnesses have claimed to have seen this petitioner committing the offence. Petitioner is in custody since 11.06.2025. Chargesheet has already been submitted.
5. However, learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation and period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Bhagwanpur P. S. Case No. 143 of 2025.
