1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. The petitioner seeks regular bail in connection with Paliganj Police Station Case No. 152 of 2024, dated 25.04.2024, disclosing offences punishable under Sections 341/323/302/120-B of the Indian Penal Code.

3. The prosecution case, as per the First Information Report, is that the petitioners, along with other co-accused persons, assaulted the wife of the informant by means of lathi and danda, due to which she succumbed to the injuries.

4. Learned Counsel for the petitioner submits that the

Patna High Court CR. MISC. No.72266 of 2024(4) dt.17-01-2025 2/2 petitioners are innocent and have falsely been implicated in this case due to previous enmity. He further submits that the allegation against the petitioners is general and omnibus in nature. He further submits that there is dispute between the parties for nali and gali since long. He further submits that the petitioners are in custody since 21.05.2024, having no criminal antecedent.

5. Regards being had to the submissions advanced on behalf of the parties and taking into consideration the fact that there is specific allegation against the petitioners of assaulting the wife of the informant, leading to her death, I am not inclined to grant regular bail to the petitioner at this stage.

6. This application is, accordingly, dismissed.

7. However, the petitioners may renew their prayer for bail after one year from today, if the trial does not make any substantial progress.
