JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 16-04-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Siwan Muffasil P.S. Case No. 574 of 2017 registered under Sections 272 and 273 of IPC and Sections 30(a) and 38 of the Bihar Prohibition and Excise Act, 2016.

16 liters of country made liquor is said to have been recovered from the bamboo cluster, located behind the house of the petitioner and he managed to escape.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He was not apprehended on spot. He has no concern either with the seized

Patna High Court Cr.Misc. No.21083 of 2018 (2) dt.16-04-2018 2/2 liquor or with the place of recovery. He has been falsely implicated in the case at the instance of his enemies. Though one more case under Excise Act has been lodged against the petitioner, but he is on bail in the aforesaid case. He has been languishing in custody since 23.12.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge, Siwan in connection with Siwan Muffasil P.S. Case No 574 of 2017.
