The petitioner seeks bail in Kudhni P.S. Case No. 465 of 2017 registered under Section 341, 323, 354, 307, 504, 506 and 511 of the Indian Penal Code.
Petitioner is said to have assaulted his wife and pressed his neck. He is also said to have torn the blouse of her daughter-in-law when she rushed to rescue her mother-in-law. It is submitted by learned counsel for the petitioner that the petitioner happens to be husband of the informant and no such occurrence as alleged ever took place. As a matter of fact, there was some family feud between the informant and the petitioner and the maternal people of the informant has got the
Patna High Court Cr.Misc. No.15298 of 2018 (02) dt.19-03-2018 - 2 - aforesaid case filed by the informant falsely implicating the petitioner in the aforesaid case due to aforesaid feud. Informant has not sustained any injury at all. The petitioner has been languishing in custody since 23.11.2017.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 3rd, Muzaffarpur in connection with Kudhni P.S. Case No.465 of 2017, subject to condition that the petitioner will not commit such occurrence in future else his bail bond shall stand cancelled. (Prakash Chandra Jaiswal, J) Trivedi/- U T
