JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-02-2020 The petitioner seeks regular bail in connection with Delha P.S. Case No. 142 of 2019, registered for offences punishable under Sections 420, 406, 379, 120(B) and 34 of the Indian Penal Code.

Prosecution case is that the petitioner took the vehicle of the informant with himself and, thereafter, he informed the informant on phone that the vehicle has been snatched away by some unknown person. Informant suspects that the petitioner sold the vehicle to some other person.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and immediate after theft of vehicle, he has informed the informant. Further submission is that he has no criminal antecedent and he has been in judicial custody since 29.05.2019.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Delha P.S. Case No. 142 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
