The petitioner, who is in custody, seeks bail in connection with Jamalpur/Rail P.S. Case No. 96 of 2017 registered for the offence punishable under Sections 306, 376, 506, 34 of the Indian Penal Code and Section 4 of Dowry Prohibition Act The FIR has been instituted on the basis of written report of informant. The informant has alleged in his written report that he received telephonic information regarding the death of his daughter Archana Kumari, then he went to Jamalpur Rail Police station and identified the dead body as his daughter. It has been further alleged that petitioner and his

Patna High Court Cr.Misc. No.15389 of 2018(3) dt.12-04-2018 2/3 daughter were close to each other since last 5-6 years and when petitioner joined the service as a Constable he refused to marry with his daughter and started to demand Rs. 5 lacs and a Bolero Jeep.

Learned counsel for the petitioner submitted that he is innocent and has been falsely implicated in this case. It has been further submitted that petitioner is a constable of B.M.P.- 9 and he was posted at Jamalpur at the time of occurrence and was undergoing training. Petitioner has solemnized marriage with Ekta Kumari on 21.09.2017 and allegation of demand of dowry to marry deceased Archana Kumari is false and baseless. It was an accidental death. Subsequently informant has also filed an affidavit stating therein that his daughter had committed suicide after having having knowledge of marriage of petitioner. Petitioner has no criminal antecedent and he is in custody since 15.11.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Railway, Kiul, in connection with
