1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Sonpur P.S. Case No. 576 of 2021 dated 03.10.2021 registered for the offence punishable under Sections 363, 367 and 369 of the Indian Penal Code.

3. Mr. Kuldeep Kumar, Learned counsel for the petitioner submits that the petitioner is a widow lady having no criminal antecedent and there is no direct evidence against her and she has been made accused mainly on the basis of confessional statement of co-accused Asha Devi and the

No.67820 of 2022(9) dt.08-07-2024 2/3 kidnapped boy was recovered on the disclosure of the coaccused Sanjeev Kumar, who has been granted bail by this Court vide order dated 13.03.2024 passed in Cr. Misc. No.- 14060 of 2024. It is further submitted that the petitioner has been languishing in jail since 09.08.2022 and her trial has started and there is no significant progress in her trial and as per his information after 13.03.2024, no prosecution witness has turned up in the trial of the petitioner and in this regard the status report sent by the trial court may be produced.

4. Mr. Arvind Kumar Pandey, learned APP appearing for the State has opposed the bail prayer.

5. Considering the above submissions and mainly the petitioner's custody period, her fair and clean antecedent and coupled with the privilege of bail to the co-accused having been granted by this Bench, on whose disclosure, the kidnapped boy is said to have been recovered and there is no significant progress in the trial of the petitioner, in my opinion in the said circumstances, the petitioner deserves to the privilege of bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Sonpur
