2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 406 and 420 of the Indian Penal Code.
3. As per allegation in the FIR, informant has deposited total an amount of Rs. 1,50,000/- in 17 installments to CSP counter of Allahabad which was being operated by the petitioner. It is alleged that petitioner has defalcated the said money and had not credited her deposited amount in her account.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. All the transactions were made in the year 2018 to 2021 but the FIR has
Patna High Court CR. MISC. No.68729 of 2023(3) dt.02-12-2023 2/2 been lodged after much delay of about two years, which creat doubt in genuineness of the prosecution story. Petitioner has got no criminal antecedent and languishing in judicial custody since 3.8.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail after framing of charge . The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Buxar in connection with Rajpur P.S. Case No. 90 of 2023.
