2. The petitioners apprehend their arrest in connection with Complaint Case No. 1003 of 2021, registered for the offences punishable under Sections 417, 419, 420, 467, 120(B), 34 of the Indian Penal Code.
3. As per allegation, the accused persons, including
Patna High Court CR. MISC. No.69761 of 2023(2) dt.01-11-2023 2/3 the petitioners, hatched a conspiracy and asked the complainant to come at Registry Office along with her husband. Thereafter, the accused persons took the signature of complainant on a blank paper and executed the sale deed of the land in favour of petitioner no. 1 namely Reena Anand. After grabbing her land, petitioner no. 1 along with her husband (Petitioner no. 2) tried to oust her from her land.
4. The learned counsel for the petitioners has submitted that the petitioners are son and daughter-in-law of the complainant. She has filed the complaint on the false ground being instigated by the other sons and daughters of the complainant. As a matter of fact, petitioner no. 1 is bona fide purchaser of the land executed by the complainant after receiving the entire consideration money. Moreover, the complainant has filed a Title Suit No. 153 of 2021 for cancellation of the sale deed. The petitioners are the persons of clean antecedent.
5. Considering the above-mentioned facts and circumstances, especially the fact that a civil suit for cancellation of the sale deed has already been filed, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on
Patna High Court CR. MISC. No.69761 of 2023(2) dt.01-11-2023 3/3 furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class Katihar in connection with Complaint Case No. 1003 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.
