Petitioners apprehend arrest in a case registered for the offences punishable under Sections 147, 323, 354, 307, 379, 506/34 and other allied sections of the Indian Penal Code. As per prosecution case, all the accused persons including these petitioners entered into the house of the informant and assaulted her by means of leg, fist and iron rod. It is further alleged that petitioner No. 1 tore the blouse of daughter-in-law of the informant and also snatched away gold chain from neck of the informant and petitioner No. 2 also snatched away Mangalsutra from the neck of daughter-in-law of the informant.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in

Patna High Court CR. MISC. No.2288 of 2023(2) dt.28-03-2023 2/2 this case. As a matter of fact, both parties are admittedly agnates and the informant along with her family members were residing at Mumbai for their livelihood. The petitioners were willing to purchase one flat at Mumbai for which they paid advance money to the son of the informant namely Sanjay, through bank transfer and cash. But neither the flat was arranged nor the money was refunded and when the petitioners pressurized the son of the informant for returning the amount, informant lodged this false and concocted case against them.

Considering the aforesaid facts and circumstances, let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of concerned Court of Siwan District where the case is pending in Guthani P. S. Case No. 292 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
