The petitioner seeks bail in connection with Hajipur Nagar P.S. Case No. 365 of 2017 registered under Sections 399, 402 of the Indian Penal Code and Section 25(1B)a, 26 II, 35 of Arms Act. The petitioner along with other accused persons are said to have congregated at the place of occurrence for committing dacoity and the petitioner and one other accused persons were apprehended while other managed to escape and one country made loaded pistol along with a live cartridge was recovered from the possession of the petitioner. No.15396 of 2018(2) dt.19-03-2018 2/2 petitioner that the petitioner has been falsely implicated in the case at the instance of his enemy by planting the aforesaid recovery from his possession. The petitioner has been falsely implicated in some other cases by the police showing as unknown accused. He has been languishing in custody since 31.05.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Nagar P.S. Case No. 365 of 2017.
