The petitioner apprehends his arrest in connection with Suppi P.S. Case No. 86 of 2019, registered under Sections 272/273/414/34 of the Indian Penal Code and Section 30(a) of the Bihar Excise and Prohibition Act.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Further submission is that nothing has been recovered from the conscious possession of the petitioner and similarly situated co-accused person has been granted anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No. 46964 of 2019 vide order dated 29.07.2019 (Annexure No.2).

II, Sitamarhi-cum-Special Judge Excise Act, Sitamarhi in connection with Suppi P.S. Case No. 86 of 2019 subject to the condition as laid down under Section 438(2) of the Cr.P.C.
