JUSTICE PURNENDU SINGH ORAL ORDER 24-03-2023 Heard Mr. Dhanjay Kumar, learned counsel assisted by Mr. Kundan Kumar Ojha, learned counsel appearing on behalf of the petitioner and Mr. Jai Prabhat Kishore, learned counsel appearing on behalf of the State.
2. Learned counsel appearing on behalf of the petitioner informs this Court that during the pendency of the present writ petition, the petitioner has died, however he has received instruction that the heirs of the petitioner have not disputed the fact that the total amount of retiral dues have not been paid and they have no interest in pursuing the present writ petition.

Considering the aforesaid fact the present writ petition is permitted to be withdrawn with a liberty to the heirs of the petitioner if they find that any dues payable to the deceased employee still remains to be paid then in that case they must file a detailed representation in accordance with law in support of their claim to be the heirs of the deceased employee namely Sita Devi, deceased petitioner whose husband had retired on 31.01.2016 from the post of Assistant Teacher, High School, Morsand, District- Samastipur.
4. Accordingly, the present writ petition stands disposed of.
