JUSTICE SUDHIR SINGH ORAL ORDER 13-04-2018 Heard learned counsel for the petitioners and learned APP for the State. A supplementary affidavit has been filed on behalf of the petitioners which is kept on record. Counsel for the petitioners is permitted to make necessary correction in paragraph no. 1 of the application in the light of the supplementary affidavit filed on behalf of the petitioners in course of the day.

The petitioners seek bail in a case instituted for the offences under Sections 342, 307, 498A/34 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act in which later Section 304B IPC was added.

Allegation against the petitioners is of committing torture and assault upon the deceased and thereafter killed her due to non-fulfilment of demand of dowry.

No.18706 of 2018(3) dt.13-04-2018 2/2 It has been submitted on behalf of the petitioners that the petitioners are in custody since 24.01.2018 and have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The petitioners have has falsely been implicated in the present case due to petty family dispute. The petitioner no. 1 is bhainsur, petitioner no. 2 is gotni and petitioner no. 3 is father-in-law respectively of the deceased. They are separate in mess and property from the husband of the deceased. The husband of the deceased is in custody. On behalf of the State, it is submitted that the petitioners are named in the F.I.R/complaint case.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Hilsa, Nalanda in connection with Sessions Trial No. 60 of 2018 (arising out of Islampur P.S. Case No. 42/2011).
