Petitioner, already in custody, seeks bail in Ahiyapur PS Case No. 712 of 2017 registered under Sections 399, 402, 115, 120B of the IPC and Sections 25(1-b)a, 26(ii) and 35 of the Arms Act. Submission is that only one country made pistol with one live cartridge was recovered from the possession of the petitioner, he is in custody since 6.9.2017, has no criminal antecedent and seeks bail of the petitioner on the ground of parity as another co-accused Abinash Kumar has been admitted to bail vide Cr. Misc. No. 7333 of 2018.

Having considered the said facts and circumstances, the petitioner Amit Kumar Pandey @ Amit Pandey is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of 14th Additional Sessions Judge, Muzaffarpur in connection with Ahiyapur PS Case No. 712 of 2017.
