2. The petitioner apprehends arrest in connection with Gopalganj (Town) PS Case No.165 of 2023 dated 02.03.2023, instituted under Sections 8(c), 21(a) of the NDPS Act.

3. The allegation is of recovery of 4.88 gram smack like substance from the house of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing has been recovered from conscious possession of the petitioner. The local police has falsely implicated the petitioner because the brother of the petitioner had sent a complaint to the Superintendent of Police against their conduct.

5. Learned APP has opposed the prayer for bail.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, I am not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, prayer of the petitioner for grant of anticipatory bail is refused.

8. The application stands disposed of.
