2. The petitioner seeks regular bail in a case registered for the offence punishable under Sections 147, 323 , 341 , 379, 504 and 506 of the Indian Penal Code & Section 302 of IPC . 3 . As per prosecution case , on the alleged date and time of occurrence , this petitioner along with other co-accused persons came at the shop of informant and abused and assaulted him and also looted the shop .
4. Learned counsel for the petitioner submits that the present case is in retaliation to Lalganj PS case No. 320/ 2023 which was lodged against the informant and others. Allegation of assault and abuse is general and no specific overt act is alleged against him. Petitioner is in custody since 24.06.2024 . Chargesheet has already been submitted.
Patna High Court CR. MISC. No.72013 of 2024(2) dt.19-12-2024 2/2 5 . Learned A.P.P. for the State vehemently opposed the bail application .
6. Considering the nature of accusation and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Vaishali at Hajipur in connection with Lalganj P. S. Case No. 319 of 2023 . (Prabhat Kumar Singh, J) Koushik/- U T
