Heard learned counsel for the parties.

The petitioners apprehend their arrest in a case registered for the offence under Section 354(C)/34 of the Indian Penal Code and Section 67(a) of the I.T. Act. It is alleged that on the alleged date and time of occurrence, these petitioners captured obscene photographs of informant in their mobile and thereafter, got it viral and on protest by informant, they committed Maarpeet with her. It is submitted on behalf of petitioners that as a matter of fact, during the last election, a quarrel took place between the

Patna High Court CR. MISC. No.70683 of 2022(3) dt.12-05-2023 2/2 parties with regard to casting of votes on the date of election and due to that reason, this false and concocted case has been lodged. Informant and petitioners are next door neighbours. Petitioners have got clean antecedent.

Learned A.P.P. for the State and learned counsel for the informant vehemently opposed the prayer for bail. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Gopalganj in connection with Vijaipur P.S. Case No. 130 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
