Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 447, 341, 323, 307, 354, 504, 506, 34 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case as lodged by the informant is that when he had gone to see his field, he found that accused persons were cutting the ridge of the field and on protest by the informant accused persons used filthy words and threatened with dire consequences. On 12.07.2019, the accused namely,

No.67636 of 2019(3) dt.16-11-2019 2/3 Rajkumar Singh and Karan Singh came to his residence and started using filthy words and assaulted the informant with Lathi, Danda, Khanti and rod. Accused Kamta Singh assaulted the informant with rod therefore the informant became unconscious and fell down and thereafter Rajkumar Singh assaulted him with rod on arm and thereafter his wife came to rescue but she was also assaulted by the accused. Learned counsel for the petitioners submits that the petitioners are innocent and have not committed any offence as alleged and due to previous land dispute the informant has lodged a false case with intention to put pressure against them. As per allegation, the petitioner no.

1 assaulted the informant on left shoulder however the same is simple in nature as evident from the injury report. Learned counsel for the petitioners further submits that petitioners have no criminal antecedent. In the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M.
