2. The petitioner apprehends his arrest in connection with Banjariya P.S. Case No. 363 of 2025, registered under Sections 374 and 275 of the BNS and Sections 30(a) and 41 of the Bihar Excise Amendment Act, 2022.
3. As per the first information report, on an information that wine is being prepared and sold on the bank of Jhakiya River, the police team reached there and on seeing the police party three persons after throwing the jute bags started fleeing away, despite being chased, they could not be apprehended. However, on search 150 liters of country made liquor was recovered and seized.
4. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedents and his name has surfaced on the basis of statement made by local persons and the
Patna High Court CR. MISC. No.66234 of 2025(2) dt.24-09-2025 2/2 Chowkidar, whereas this petitioner is in no way connected with the alleged offence and the seized articles does not belong to him.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above named, is directed to be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Court No.1, East Champaran at Motihari, in connection with Banjariya P.S. Case No. 363 of 2025 subject to the condition as laid down under Section 482 (2) of the B.N.S.S., 2023.
