1. The Writ petition is filed seeking a direction for payment to the petitioner, who has completed the work of Quarter No. 11, Road No. 3 at Kajipur, Patna for the year 2015-16, as per the agreement No. 378 of 2016-17, and for grant of any other consequential or incidental relief.

2. The brief facts of the Writ petition disclose that the petitioner completed the work as per the agreement, and a total amount of Rs. 96,900/- is payable to him. However, the respondent authority have not made the said payment, therefore, the present Writ petition has been filed.

Patna High Court CWJC No.15967 of 2017(3) dt.24-06-2025 2/2 filed by the respondent, contending that the Writ petition is not maintainable in view of the Bihar Public Works Contracts Disputes Arbitration Tribunal Act, 2008. If at all the petitioner has any grievance, he has to file a reference case before the Disputes Arbitration Tribunal, Patna, which is fully functional.

4. At this juncture, the Learned counsel for the petitioner contended that he has made a representation before the respondent No. 4, as per Annexure 3, and seeks a relief for a direction to the authority to dispose of his representation.

5. Considering that the representation of the petitioner is pending before the authority, the concerned authority is directed to dispose of the representation within three months from the date of receipt of this order.

6. With the aforesaid observations, the Writ petition stands dispose of.
