JUSTICE ARUN KUMAR ORAL ORDER 21-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Kotwali PS Case No. 270 of 2017 registered under Sections 417, 418, 419, 420, 467, 208, 201 and 120B of the IPC.

The allegation in brief is that one Ganesh Kumar topped the list of successful candidates of the Intermediate examination but he had appeared from the concerned school by changing his age and suppressing the fact that he had earlier appeared in the Intermediate examination with the connivance of the Principal and the teachers of the said school.

Learned Counsel for the petitioner submits that the petitioner is not named in the FIR, he is only an Assistant Teacher of the School from which the said candidate appeared and only material is that he was instrumental in getting him admitted but the admission was allowed by the Principal of the School.

Having considered the said facts and circumstances, the petitioner, namely, Arun Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Patna in connection with Kotwali PS Case No. 270 of 2017.
