Petitioner, already in custody, seeks bail in connection with Salkhua P.S. Case No.150 of 2017, registered under Sections 147, 148, 149, 341, 342, 302, 120(B), 504 and 506 of the Indian Penal Code as well as under Section 27 of the Arms Act.

Allegation in brief is that hearing the sound of firing after midnight, the informant saw that accused persons had surrounded his father and on exhortation given by Chhatri Mehta, Sadanand Mehta and Munna Mehta shot at the father of the informant causing his death.

It is contended that the allegation of firing is not against the petitioner rather against Sadanand Mehta and Munna

Patna High Court Cr.Misc. No.11563 of 2018(4) dt.09-04-2018 2/2 Mehta and the petitioner has been implicated in this case because of being relative of Chhatri Mehta and also not resident of the same village moreover the petitioner has no criminal antecedent.

Having considered the aforesaid facts and circumstances, petitioner Mukhilal Mehta is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Saharsa in connection with Salkhua P.S. Case No.150 of 2017.
