The petitioner is accused in connection with Barachatti P.S. Case No. 705 of 2017 registered under Sections 30(a), 38 and 47 of the Bihar Prohibition and Excise Act.
On receiving secret information about carrying of illicit liquor in a Bolero Car bearing Registration No. UP 60M7283, informant along with other police officials started checking and stopped the alleged vehicle, and petitioner, who was driving the car, was apprehended by them while he was trying to flee away and from his vehicle 400 pouches, each containing 200 ml. illicit liquor recovered.
Learned counsel for the petitioner submits that the real
Patna High Court Cr.Misc. No.7167 of 2018 (2) dt.08-02-2018 2/2 culprit succeeded in fleeing away but the petitioner was apprehended by the police. It is further submitted that petitioner has also been remanded in two other cases namely, Barachatti P.S. Case No. 652/17 and Barachatti P.S. Case No. 603 of 2017 under the same Sections and in this case he is in custody since 10.11.2017.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Gaya, in connection with Barachatti P.S. Case No. 705 of 2017. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) sushma/- U
