2. The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 420, 470, 468, 471/34 of the Indian Penal Code.

3. The prosecution case in nutshell is that informant, being an employee of the bank, found that two persons have come to withdraw Rs. 20,000/-. On suspicion, when query was made, they wanted to escape but were apprehended. Further, it came to notice that earlier they withdrew Rs. 10,000/- from the account of

Patna High Court CR. MISC. No.69291 of 2023(2) dt.03-11-2023 2/3 one Budhu Prasad Yadav. This time they also wanted to recreate the same but were apprehended.

4. It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. It is further submitted that the petitioner is an illiterate person and have no knowledge about the bank transaction but due to standing near co-accused Mantu Yadav, he has been implicated merely on the basis of suspicion. Moreover, the petitioner is languishing in judicial custody since 29.04.2023. Similarly situated co-accused, namely, Mantu Kumar has been granted bail vide order dated 25.08.2023, passed in Cr. Misc. No. 54604 of 2023 by the co-ordinate Bench of this Court.

5. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

6. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody,

The above named petitioner is directed to be enlarged on bail in connection with Tankuppa P.S. Case No. 81 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Gaya.
