The petitioner seeks bail in Sessions Trial No. 88 of 2017(468/17) arising out of Belganj P.S. Case No. 32 of 2017 registered for the offence punishable under Sections 304B/34 of the Indian Penal Code.

Informant is the father of the victim, who on 04.02.2017 in his written complaint has stated that marriage of his daughter was solemnized with the petitioner in 2016 and sufficient articles were presented at the time of marriage. However, she was being subjected to torture for non fulfillment of demand of dowry and on 03.02.2017 at about 4:30 am in the evening, he received information that his daughter has been killed by strangulation by her in-laws and thereafter he

Patna High Court Cr.Misc. No.7189 of 2018(3) dt.07-03-2018 2/2 went to the matrimonial house of his daughter and found her daughter lying dead in the room.

It has been contended on behalf of the petitioner that the victim has committed suicide and as per post mortem report cause of death has been attributed to Asphyxia due to hanging. Petitioner has got no criminal antecedent and is in custody since 22.02.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-4th, Gaya in connection with S.Tr. No. 88 of 2017 (468 of 2017) arising out of Belaganj P.S. Case No. 32 of 2017.
