The petitioner seeks bail in connection with Chausa P..S. Case No. 310 of 2017 registered under Section 30(a) of Bihar Prohibition & Excise Act 2016.

20 lts. of country made liquor is said to have been recovered from the house and motorcycles parked at the door of Bangtu Singh and petitioner and other accused persons managed to escape seeing the police party.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. The petitioner has no concern either with the house or with the aforesaid motorcycles from where the

Patna High Court Cr.Misc. No.7387 of 2018(2) dt.13-02-2018 2/2 alleged recovery is said to have been made. The petitioner has no criminal antecedent. The petitioner has been languishing in custody since 01.11.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Udakishunganj at Madhepura in connection with Chausa P..S. Case No. 310 of 2017.
